Terms of service.
Prior to booking onto the retreat, please read and ensure you understand the terms and conditions of booking below.
BOOKINGS
All bookings are made with Raquel Fitness LTD (RFL). By booking a retreat you are deemed to have agreed to these terms and conditions (such terms and conditions constituting the entire agreement between you and RFL).
DEPOSIT
To confirm your booking you will be required to pay a deposit of £80 per person per retreat. This deposit will be refundable up to one week after releasing the specific dates of the retreat. If your booking is made within 45 days of the retreat start date, then the full amount is payable at the time of booking.
CONFIRMATION & BALANCE PAYMENT
Once your booking has been accepted, we will issue a confirmation email and information pack to the email provided at the time of booking. Your invoice will also set out payment details for payments of your outstanding balance, which shall be due no later than 45 days prior to the retreat start date.
RETREAT PRICE
The price of your retreat will be secured upon payment of your deposit.
CANCELLATIONS
If you cancel your booking, the following cancellation fees will apply:
· Prior to 1st December 2024: all money paid to date will be refunded, excluding the deposit;
· Between 1st December 2024 - 7th February 2025: RFL will retain your deposit and 50% of the balance paid to date; and
· After the 8th February 2025 – RFL will retain your deposit and 100% of the balance paid to date.
If you are required to leave a retreat before the retreat end date, you will not be entitled to a refund for the remaining unused duration.
RFL may be required to cancel a retreat in the following circumstances:
· there are less than 10 anticipated attendees 28 days prior to the retreat start date;
· Force Majeure; or other events beyond RFL’s reasonable control that means it is not viable to proceed with the relevant retreat.
If RFL has to cancel your retreat, RFL will tell you as soon as possible and will offer you a choice of transferring to alternative retreat date or a full refund of monies paid.
RFL will not be liable for any incidental expenses incurred in connection with your booking (e.g. visas, vaccinations, travel insurance excess and non-transferrable flights).
AMENDING BOOKINGS
Subject to your (a) payment of a £50 transfer fee , and (b) written notice at least 45 days prior to the retreat start date, you may be able to transfer from one retreat to another and/or transfer your booking into the name of an alternative attendee.
VENUE
Unless otherwise specified at the time of booking, all retreats will take place at the Venue: Sands Beach. You acknowledge that the Venue is owned and maintained by a third party (Venue Owner).
References to the Venue shall be deemed to include all accommodation, facilities (including but not limited to the training facility and equipment therein, and equipment made available for the purposes of the Optional Activities.)
INCLUSIONS
The retreat price includes (for the duration of the retreat):
· accommodation;
· airport transfers (please note if you do not book the recommended flights the transfer may not be available - please inform us if you are not booking the recommended flights);
· a welcome drink;
· all scheduled training sessions (as specified in the RFL Information Pack);
· half boar meals (as specified in the RFL Information Pack);
· kayaking;
· paddleboarding;
· mountain biking;
· hiking; and
· swimming (beach and pool).
ADDITIONAL CHARGES
During the retreat, it may be possible to purchase massage therapies and private 1-2-1 appointments with the coaches. These sessions will be subject to additional charges as set out in the RFL Information Pack.
AGE & HEALTH
All attendees must be aged 18 or over at the retreat start date.
UNDER 18’s :Guests under 18 years old can attend the retreat with a parent/guardian. The parent or guardian will take full responsibility for the minor during the retreat.
RFL does not have an upper age limit but remind you that some of the training sessions will be physically demanding so all attendees must ensure that they are suitably fit to allow full participation.
PASSPORTS & VISAS
It is your responsibility to ensure that you have obtained all necessary passports and visas prior to the retreat start date, to enable you to attend the retreat. RFL will not be liable if you are refused entry to Spain because you lack the correct passport, visa or other required travel documentation.
TRAVEL INSURANCE
It is your responsibility to ensure that you have obtained appropriate travel insurance prior to the retreat start date. Your insurance must cover against personal accident, death, medical expenses and emergency repatriation and we recommend minimum coverage of £200,000. RFL strongly recommend your insurance also covers cancellation, curtailment, personal liability and loss of luggage / personal effects. Please ensure you bring details of your travel insurance policy and emergency contact number with you on the retreat.
AUTHORITY
Each retreat will have a specified Retreat Director, who will be introduced to all attendees at the welcome talk. The decision of the Retreat Director is final on all matters likely to affect the safety or wellbeing of any attendee, coach or staff member on the retreat. If you fail to comply with a decision made by the Retreat Director, the Retreat Director may direct you to leave the Venue and the retreat immediately, with no right of refund.
CONDUCT
All retreat attendees must refrain from (a) any illegal act (b) conduct or use of language which may give rise to offence being taken by other attendees, local residents, RFL , the Venue Owner, and/or their employees or agents, and (c) causing damage to the Venue and/or any personal property. If the Retreat Director becomes aware of any such conduct, they may in their absolute discretion, ask you to leave Venue and the retreat immediately with no right of refund.
RISK WAIVER
You acknowledge that the nature of the trip is extremely active and participation in both the scheduled training sessions and Optional Activities, involves a degree of personal risk.
LIMITATION OF LIABILITY
RFL will not be liable for any damage or loss as a result of a breach of these terms and conditions, where such damage or loss is (a) directly attributable any act or commission by you (b) attributable to any third party unconnected with SFR or the Venue Owner (c) due to unavoidable and extraordinary circumstances beyond SFR’s control, and (d) Force Majeure. RFL cannot accept liability for delayed transport arrangements and /or missed transport if you or any member of your group misses a flight or other transport arrangement or if your transport is delayed. In the case of flights, in some circumstances under EU law, you may be entitled to refunds or compensation from the airline. Further information is available on this from the Civil Aviation Authority at www.caa.co.uk/passengers.
Neither RFL nor the Venue Owner, their employees or agents will be liable for any loss or damage to any personal property or vehicle belonging to you during the retreat, save where such loss or damage is directly attributable to their negligent act or commission.
Nothing in these terms and conditions shall limit RFL’s liability for (a) death or personal injury caused by the negligence of RFL or its employees, and/or (b) fraud or fraudulent misrepresentation.
COMPLAINTS PROCEDURE
If you experience any problems during the retreat and wish to make a complaint, please report in the first instance to the Retreat Director as soon as reasonably practicable but not later than 7 days after the retreat end date. Failure to provide notify the Retreat Director will preclude you from being entitled to take any further action against RFL.
SEVERABILITY
In the event that any one or more provisions contained in these terms and conditions is deemed void or unenforceable by law, then such provision shall be severed from the contract or amended accordingly only to such extent necessary to allow all remaining provisions to continue in full force and effect.
MEDIA
During the retreat, RFL or an agent of RFL may photograph and/or video you. You consent to RFL using these
images for the purposes of social media, publicity, and advertising. You hereby grant RFL a non-exclusive,
irrevocable and loyalty free licence to use these images for such purposes. If you have any concerns about this please inform the Retreat Director who will make reasonable adjustments.
MEDICAL ASSISTANCE
If required during your retreat, RFL will provide you with appropriate information on health services together with
any such reasonable travel required to seek assistance from medical professionals, as soon as reasonably
practicable. Please make sure you have a EU healthcare and appropriate insurance.
PRIVACY
RFL will treat any personal data obtained from you in accordance with this privacy policy, to which the provisions of the General Data Protection Regulations will apply, you will need:
to seek formal advice as to the suitability of any such privacy policy. Any policy will need to be realistic and reflective of RFLs actual internal practices because a policy with its paper if it is being complied.
FINANCIAL PROTECTION
RFL is required by the Packgage Travel and Linked Travel Arrangements Regulations to ensure any monies paid by
you for any retreat, is secured in the event of our insolvency prior to or during your retreat.
FORCE MAJEURE
For the purposes of these terms and conditions, Force Majeure shall mean any event beyond RFL or the Venue Owner’s reasonable control, including but not limited to (a) acts or threat of terrorism (b) civil strife (c) significant risk to human health such as outbreak of serious disease at or around the Venue and/or Spain (d) natural disasters such as fire, flood, earthquake or weather conditions which render it impossible to travel to or remain at
the Venue safely (e) war or threat thereof (f) any residual consequences of the aforementioned.
GOVERNING LAW & JURISDICTION
These terms and conditions are governed by the laws of England and Wales. In the event of any dispute between you and RFL, both you and RFL submit to the exclusive jurisdiction of the courts of England and Wales.
